We respect your privacy and are committed to protecting your Personal Information. Through this policy we would like to let you know how we collect, use, share and protect your Personal Information.

In this policy, 'Matador', 'we', 'our', 'us' or 'the Company' refers to Matador Digital (Pty) Ltd and any other company or subsidiary that forms part of Matador and where reference is made to 'you' and 'your' it means each natural person or juristic entity who uses our LoyaltyPay application or associated services. The LoyaltyPay application refers to Matador's loyalty and rewards platform operating under the LoyaltyPay brand.

Only Personal Information that is necessary for the purposes described in this policy will be collected and we will only process Personal Information in compliance with applicable laws, including the Protection of Personal Information Act (POPIA), and in ways that are for, or compatible with, the business purposes for which the Personal Information were collected or that are subsequently authorised by you.

What is Personal Information?

In general, Personal Information comprises any information that relates to a natural person or a juristic entity and can be used to directly or indirectly identify that natural person or juristic entity including, but not limited to:

  • Race, gender, ethnicity, sex, pregnancy, marital status, disability, religion, etc.;
  • Names, contact addresses, contact details and ID number;
  • Company name and registration number;
  • Locations, IP addresses and cookie data;
  • Health, genetic and biometric data;
  • Education and employment history;
  • Criminal record and behaviour;
  • Personal opinions and views;
  • Private and/or confidential correspondence.

What is Special Personal Information?

Personal Information that includes, for example, any information concerning religion, race, ethnicity, health or sex life, trade union membership, biometric information and criminal behaviour is regarded as Special Personal Information.

What is Data Processing?

Any manual or automatic actions performed on personal information including the collecting, recording, collating, disseminating, organising, updating, structuring, storing, using and erasing of data.

How Do We Collect Your Personal Information?

We may collect information from you in the following ways:

  • Directly from you;
  • From your device or a device that is associated with you;
  • Through in-app technology;
  • From a subsidiary of our company;
  • From a company we have partnered with to provide a specific service offering to you; or
  • From an external third-party source.

We may also collect technical information when you visit or use the LoyaltyPay application and its associated services. This may include information such as Internet Protocol (IP) address, the type of mobile device you use, your device operating system and browser type, a unique device identifier and other information about your session while using the LoyaltyPay application or associated services.

We will only collect and use personal information if we are lawfully permitted to do so. The lawful bases we rely on for processing this information are:

  • We have your consent to do so;
  • We have an obligation to carry out a necessary action for the cancellation of a service or product procured through the LoyaltyPay application or related to any associated services;
  • We are required by law to process your personal information;
  • The processing protects your legitimate interests;
  • We have a legitimate interest to pursue; and/or a third party has a legitimate interest to pursue.

Information We Receive Directly From You

You actively share information with us in various ways when using the LoyaltyPay application and associated services. For example, you share information with us when you:

  • Register for the LoyaltyPay application and its associated services;
  • Transact through the LoyaltyPay application;
  • Request customer service or contact us;
  • Participate in a benefit program partnered with us; and
  • Participate in a contest, promotion or customer survey.

All personal information supplied to the Company must be accurate, up-to-date, not misleading and complete in all respects. You are required and commit to immediately notify the Company of any changes to your Personal Information.

Information Received From External Third-Party Sources

We may receive information about you from other sources and external third parties we have partnered with to provide you with the LoyaltyPay application and associated services. We need to collect or receive this information from other parties to provide you with the products and services you have signed up for or to provide necessary information to another party you have contracted with.

Why Do We Collect and Process Your Personal Information?

In order for us to offer you the LoyaltyPay application and associated services, we need to collect, use, share and store personal and financial information about you:

  • To register, create and maintain your LoyaltyPay application account;
  • To use your unique device identifier to link your application to your device for security purposes;
  • To audit and monitor your transactions and engagement;
  • To provide customer service;
  • To fulfil transactions for products and services;
  • To update technical and operational functionality and conduct analytics;
  • To protect the integrity and security of our business;
  • To help prevent fraud;
  • For research and development;
  • To provide marketing material subject to your right to opt out; or
  • To comply with legal obligations.

All Personal Information will be used and/or retained only for the purposes for which it is collected, after which it will be permanently destroyed unless retention is required by law or you have consented to extended retention.

Sharing of Personal Information

We may share personal information within our group of companies or with service providers for specific business purposes. We will not sell or rent your personal information. Where necessary, we may share information in the event of business restructuring, legal requirements, or with your consent.

If personal information is transferred outside South Africa, we ensure appropriate safeguards in line with POPIA.

LoyaltyPay Application

By using the LoyaltyPay application or providing your information, you expressly consent to our collection and use of your information in accordance with this policy.

If you disclose personal information relating to other people, you warrant that you have authority to do so.

If you do not agree to this policy, please do not use the LoyaltyPay application.

How Do We Protect Your Information?

We implement technical, administrative and physical security measures to protect your personal information from unauthorised access or disclosure.

Access to your information is restricted to authorised personnel.

Whilst we take reasonable steps to protect your information, we cannot guarantee absolute security unless disclosure arises from our gross negligence.

How Long Do We Keep Your Information?

We retain personal information only as long as required for lawful business purposes or as required by law.

Your Data Protection Rights

You have the right to:

  • Request access to your personal information;
  • Request correction or deletion of inaccurate information;
  • Request destruction of information no longer required;
  • Opt out of marketing communications.

Changes to this Privacy Policy

We may amend this Privacy Policy from time to time. Any amendments will be posted in the LoyaltyPay application.
